Contest Rules:
You MUST read the rules before you enter the “Are you Mackenzie Blue?” contest (“Contest”). ALL KIDS UNDER THE AGE OF 13 MUST ASK A PARENT TO SUBMIT THE VIDEO FOR YOU AND READ THE RULES! MANY GIRLS WILL ENTER, BUT ONLY 10 LUCKY FINALISTS WILL BE SELECTED!!! Here are the official contest rules:
1. Eligibility. ALL GIRLS UNDER THE AGE OF 13 MUST HAVE A PARENT SUBMIT THEIR VIDEO TO BE ELIGIBLE TO ENTER THE CONTEST AND ADVANCE TO THE NEXT ROUND OF COMPETITION. ALL GIRLS MUST FOLLOW THESE OFFICIAL RULES IN ORDER TO BE ELIGIBLE TO ADVANCE.
2. Agreement to Official Rules. By participating in the Contest, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Contest.
3. Sponsor. The Sponsor for this Contest is Mackenzie Blue, LLC, a New Jersey limited liability company located at 1018 Laurel Oak Road, Suite 1, Voorhees, NJ 08043.
4. Timing.
a. FIRST ROUND. The first round of the Contest begins on June 16, 2009 at 12:00 a.m. Eastern Standard Time ("EST”), and ends on August 31, 2009 at 11:59 p.m. EST (the "First Round"). The Sponsor reserves the right to extend the First Round without any prior written notice.
b. SECOND ROUND. The second round of the Contest begins on September 25, 2009 at 12:00 a.m. Eastern Standard Time ("EST”), and ends on October 25, 2009 at 11:59 p.m. EST (the "Second Round"). The Sponsor reserves the right to extend the Second Round without any prior written notice.
5. Video Submissions. All video submissions must: (1) be no longer than one (1) minute, (2) be based on materials from book one of Mackenzie Blue, and (3) MUST NOT contain any inappropriate, vulgar or obscene language or materials.
6. How to Advance.
a. FIRST ROUND. The top 10 finalists will be selected based on the following criteria: Rating of the video submission, the number of times the video submission is viewed on YouTube, and a final review by the Sponsor. The Sponsor reserves the right to deny any entrant the ability to advance to the next round of competition. The top ten (10) finalists from the First Round will advance to compete in the next round of the “Are You Mackenzie Blue?” contest. Sponsor will conduct at least one additional round of competition in this Contest. Sponsor reserves the right to allow additional entrants prior to the final round of the competition. The rules for each round will be posted on MackenzieBlue.com on the first day of each round.
b. SECOND ROUND. The top 3 finalists will be selected based on the following criteria: The number of votes cast on www.mackenzieblue.com and a final review by the Sponsor. The top three (3) finalists from the Second Round will advance to compete in the next round of the “Are You Mackenzie Blue?” contest. Sponsor will conduct at least one additional round of competition in this Contest. Sponsor reserves the right to allow additional entrants prior to the final round of the competition. The rules for each round will be posted on MackenzieBlue.com on the first day of each round.
7. PRIZE. At the end of the contest, ONE (1) lucky girl will win the chance be the “Real Mackenzie Blue?” and the chance to negotiate a talent agreement with the Sponsor.
8. Publicity. Except where prohibited, your entry in the Contest constitutes your consent to Sponsor’s and Sponsor’s agents’ use of your name, likeness, photograph, voice, opinions and/or hometown and state or province for promotional purposes in any media, worldwide, without further payment or consideration. For children under thirteen (13), such consent will only be to the extent allowed by COPPA and otherwise allowed by law.
9. General Conditions. Except where prohibited by law, Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be in violation of these Official Rules or to be inappropriate
10. Limitations of Liability: The Sponsor and it’s agents are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Content; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest. If for any reason your entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, your sole remedy is another entry in the Contest. If the Contest has been discontinued you will have no further remedies.
11. Disputes. Except where prohibited, you agree that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the state or federal courts located in New Jersey, U.S.A.; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or your rights and obligations or those of Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of New Jersey, U.S.A. without giving effect to any choice of law or conflict of law rules which would cause the application of the laws of any jurisdiction other than the State of New Jersey, U.S.A.. |
